It's not false advertising (they weren't being intentionally deceptive), but if Blizz doesn't meet the 12/21 date they have to refund the money to anyone who pre-purchased (and who asks). This doesn't mean that you get the expansion for free though. It just means that you can get your money back but have to re-buy the game to play. As if this isn't bad enough for Blizzard (they don't want to be giving any money back) it's made worse by the 90 boosts. My understanding is that if people have received a pre-purchase refund so far (for whatever reason) those boosted 90s are locked. It sucks to have a character locked because you requested a refund where Blizzard is at fault for not keeping to the deadline (and thus breached the "purchase contract" if you will) so how to handle the whole boosted 90s thing makes the situation even harder for them to handle so ... they'll release on or before that date come hell or high water.
