    It's Now Sexual Assault To Have Sex With A Woman While Using a Pierced Condom...

    ...but only if the man is the one who pierced it!

    This seems like a very sexist ruling, where's the crime if the woman pierces the condoms herself in order to get pregnant against the man's wishes? What if she pokes holes in them and then claims it was the man, it seems like a very hard crime to defend yourself against in a case of a false accusation.

    Sexual assault (aggravated sexual assault, no less) seems like a stretch, but it definitely is and should be a crime. While it's still an offense for both parties, I can see why the bias might be greater against the man here, since the woman will be bearing the burden of pregnancy. Deceit is obviously involved in both cases, but it's the difference between inflicting a pregnancy onto yourself, and inflicting a pregnancy onto another.

    Using a broad Wiki definition:

    Sexual assault is any involuntary sexual act in which a person is threatened, coerced, or forced to engage against their will, or any sexual touching of a person who has not consented.
    Yeah, this obviously qualifies in either direction. If someone hasn't consented to fluid transfer and the attending risks, you're assaulting them.

    Pregnancy is a problem but so is fatherhood. I agree pregnancy is worse but the other direction is still very serious particularly when the legal system holds you responsible for the kid you never wanted. At least the female can choose to end her pregnancy if she desires.

    Then the same should apply regardless of who pierced it. If one partner lies to the other or compromises the integrity of whatever birth control that is being used, then that partner should be charged with sexual assault.

    Of course - that's why I said "this obviously qualifies in either direction".

    I will note that unintended fluid transfer is a bit worse than just compromising birth control, as it carries substantially increased disease risk, which makes the harm worse than "just" unintended reproduction. In any case, I don't understand people's impulse to be angry about this charge. Why in the world wouldn't we want this to be a criminal action? Whatever court this is isn't in a position to do anything other than decide on this case, and they're surely doing it right.

    What a backwards logic. Adding more and more circumstances to the situation until the woman is free of any faults. "If she lied to you and you STILL...", how on earth is one supposed to know he's being lied to?

    Please, if a woman decides to lie about whether or not she is on the pill, it's a choice she makes in full awareness of the possible consequences; while in the same time deluding the man and depriving him of the right to chose whether or not he wants to become a parent. Issues might especially arise if both parties are in a long term relationship or even marriage and they disagree about their wishes of becoming parents. Many men do not use condoms after she has been using the pill for a longer period of time and some sort of trust relationship was build.

    Putting the blame on men alone is pure sexism and ignorance. Such ideology, or rather way of thinking, should naturally come as repulsive.

    No where in the article does it say women can get away with it either

    For what it's worth, the pill is only 100% effective if used correctly, which some women do not. you're making the choice to trust they've been following the correct way to use the pill if they say this. Also, condoms are used for more than just preventing pregnancy. Not using a condom exposes you to STDs. Unless my partner's been tested, I'd never go near them without one.

    It's not sexism, or ignorance. It's literally stupid to not use a condom unless you have proof beyond a reasonable doubt that it'll be safe from STD and pregnancy due to other forms of birth control.

    It's interesting, this isn't about STDs or fluid transfer, but "a sufficiently serious deprivation for the purposes of fraud vitiating consent."

    It will be interesting if this goes higher, because it opens the door for women who knowingly deceive men into conception as also committing fraud.
