Whether it's first degree or not is really irrelevant to me. If there's any doubt whatsoever, it's whether or not he murdered the guy. The girl was very clearly deliberately executed outside of the scope of self-defense. There were other articles linked in the last few pages that talk about him taking the time to move her body and put the gun in her face before pulling the trigger. If this guy was at all frightened by her, he clearly wasn't showing it. He even outright stated he had to shoot her after she laughed at him while his gun jammed. Also, it's a small detail, but from the articles, it sounds like he probably shot her closer to ten or so times using two different firearms.
