No you don't pay for the servers that is not how it works. Its a license that says you can play this game when its available to play. It is not a contract that says I pay you and you insure that the servers stay up/I get new content. Its a license agreement, that allows you to play/use their product when it is available.
In fact, Section 11 of the EULA labeled Limitation of Liability, Indemnity it even says " BLIZZARD SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE." Best part I didn't bold that, that is how its printed in the EULA. So by agreeing to the EULA when you install you agree that Blizzard isn't liable when the service doesn't work.
I'm not white knighting either, I'm just explaining to you what you pay for each month. It is all in the EULA you agree too. Its a License agreement not a a contract for goods and services.
