    City of Paris to sue Fox News...

    For defamation and damages. In the struggling economy, it's already hard to attract tourism, but apparently after the media blitz following the terror attacks on satire comics, Fox News has passed off some lies as truth about Paris, including that they have some zones that are off limits to non-Muslims in the city and have let the Muslims take over.

    I wonder how this is going to play out. Not that it will phase Fox News considering the giant funding them, but I'm glad someone is taking them to task on their lies. What's really mind boggling are some of the responses to this, including "Paris, why don't you make your city a place where Muslims don't want to live?" and other such nonsense.

    Yes, there are no-go zones in Europe

    In the wake of the Fox News apology for a guest expert’s on-air claims regarding Muslim “no-go zones” in Europe, an international clamor has ensued with condemnation of Fox, claims that Muslim immigrants really do want to assimilate and a threat by the mayor of Paris to sue the cable network for “insulting” the great city.

    There’s only one problem: Europe is full of Muslim “no-go” zones, which have been documented, lamented, reported on and openly discussed for years.



    In fact, the governments of France and other European nations have identified specific enclaves, where Muslim immigrants have chosen not to assimilate, as areas in which law enforcement has lost some degree of control.

    The French government lists on its website 751 Zones Urbaines Sensibles, or Sensitive Urban Zones, that the state does not fully control, notes Middle East foreign policy expert Daniel Pipes, director of the Middle East Forum.

    News in the US is protected by the First Amendment. Paris would have to prove Fox was malicious which isn't easy. If the lawsuit happens in France, how is Paris going to collect?

    I wasn't aware that Fox said there were Muslim only zones in Paris, now I am.

    Not to dabble too much into conspiracy, but I honestly think it is more along the lines to keep the news up and current that FOX was talking out of their ass for the most part, than it is to actually win a court case.

    The US has some pretty shitty areas, but they still fall under US jurisdiction and laws. We don't have no-go zones where gangster law is in effect, but we do have high crime, "sensitive" areas which is pretty much what this is.

    Pretty old story, and also a non-starter legally, at least if they try to bring it in an American court. If they want to sue Fox through some jurisdictional contact in Europe in a French court, I have no idea from French defamation law. In the US, though, a government entity can't sue for defamation (not sure if that extends to foreign government entities as plaintiff, though). But also you can't prevail in defamation as a public figure (which surely "the city of Paris" is) on a matter of public interest without overcoming a 1st Amendment burden -- in this case, that the defamatory statements were made with actual malice. Here, even if the city of Paris were allowed to bring its case, it would have to prove by clear and convincing evidence that the statements were made with knowledge that they were false, or with reckless disregard for whether they were false or not.

    Obviously, seeing as there is obviously reasonable disagreement over what constitutes a "no-go zone" instead of total outrage that anybody could ever suggest such a thing, there's really no way the claim could be upheld. It's frivolous on its face.

    EDIT: Yeah, if the position of the French is that there aren't "no-go zones", just "sensitive urban areas", the idea of a successful defamation case that has to satisfy NYT v. Sullivan is a total joke even if there weren't legitimate questions about standing. Summary judgment for defendant Fox News granted.
