Still not a legal punishment, no.

Canada barred the folks from the Westboro Baptist Church from entering, a while back, because they were coming up to do what would end up being charged as a hate crime, here. That didn't mean they had actually (at that point) broken any laws.

Unlike the Westboro (like the UK they can ban people and maybe the US not sure, can ban people they deem undesirable) the person in question does go before a Immigration Judge and while it may be out side the normal legal realms, it still seems to play out as a trial and sentence scenario type system.
