    While related, the 5th amendment wouldn't have applied in that case, as the Supreme Court has not recognized fifth amendment rights for corporations. It was more of an issue of the rights of corporations to not be compelled to create backdoors into their software for the purpose of investigation by the government.

    It also wouldn't matter - you can only assert privilege for things that could make you culpable to a crime - you can hold a third party for not telling you the password.
    I.E if apple knew the password, it would have to tell, regardless of personhood.

    I remember reading once that prosecutors would go as far as indicting you for having just VIEWED them online since they get cached somewhere hence you are in indirect possession of it.

    Just going "Hmm I think you're guilty -> Jail -> Now I'm entitled to go through all your private stuff." is not acceptable.
