I don't know how the Austrian law works, it's just what I gleaned from the article. To apparently prosecute someone for the more extreme charges you need to prove that there was no consent involved. I assume this is so you have kinda standard statutory rape, in which people over age get whatever years for sleeping with under age people, and then so that you can further punish people that rape minors.

The legal argument seems to me to be, because of language barrier the lack of consent can't be proved or more accurately disproven. But you are right why the supreme court is asking for a re-trial is surprising.
