I don't know how the Austrian law works, it's just what I gleaned from the article. To apparently prosecute someone for the more extreme charges you need to prove that there was no consent involved. I assume this is so you have kinda standard statutory rape, in which people over age get whatever years for sleeping with under age people, and then so that you can further punish people that rape minors.
Exactly. He wasn't able to consent, because the law says, he cannot. Even """""IF""""" he wanted it (which is highly unlikely), he was, and still is, a minor. There is no question in my mind, that nobody would bat an eye, if the perp was not a refugee. I happen to not care, where you are from if you break the law. I know, how silly of me.

You know. The set of laws that handle either two underage persons or one who is a year or two from their legal counterpart. And never covered legal adults fucking people far younger AND under the age.

do you know ANYONE who asks for permission before kissing someone? I don't. I asked girls if men should ask permission before going in for a kiss they all said no. also when a guy is making out with someone do you think people stop and ask to grab parts of their body? nope. no one does that. people just go for it. if the girl /guy asks them to stop and they stop, no harm done. that's they way it is. getting rejected is not sexual assault. if they then continue using force to get what they want then theres a problem. idk what the new laws are saying but that's the way society is and has been for a long long time
