first of all, it's not a crit-cap, per-se. It's just the common plateu of which, that most mobs of +3levels/bosses stop critting.
There are exceptions, of course;
* Debuffs lowering defense
* Buffs on mobs increasing chance to crit
* Accidently sitting down
* Inherent increase in critical strike-chance (I can only name a select few, and I haven't raided ICC, so unsure there)
I'd say; Don't worry about it, you're the cap is the same as always.
And yes, I unnecessarily overcomplicate things.
I haven't been an active raider for some time now, but I'd say there's a good chance that the trash has an ability that skews the attack tables so that you're not crit immune against them at that moment. Again, I have literally no experience with ICC trash, just an educated guess.
there are rogue like mobs in that trash, that have a higher crit chance than normally.

On heroic deathwhisper 25 we had repeated situations where a mind controlled elemental shaman put down a totem of wrath (increasing critical strike chance against our raiders by 3%).

the safest thing is either 689 defense rating (since you need 140 skill, which is 688.8 rating), or 541 defense.
