    Human Rights law protecting crimals again

    Human Rights law needs a serious reform

    A couple who spent their retirement savings on a caravan only to see it stolen were astounded when police said the travellers who are living in it could not be removed as it would breach their “human rights”.

    The Law doesnt protect Criminals they are judged based on it.

    If you read the entire thing, the "owners" of the caravan now aren't the thieves and it's their only place of living. Thus forcing them out could end with the family dying from exposure. It is illegal in most countries in Europe, to force someone out into the cold - and they do not take seasons into consideration. So yeah, it ain't fun for the couple who's caravan has been found but cannot be returned.

    I don't get it. What papers do the new "owners" have to prove it belongs to them now ?! I doubt the thieves made any legal ownership papers to give to them.
    If they don't have any papers, why can't the police just evict them ?! Surely if you come home from vacation and discover some people have broken into your house and are now living there, you don't need to sue them to get your house back.

    This story doesn't seem very logical.

    "Stealing is Bad, Re-stealing is Ok" this daily comes to mind.

    but really cops are a bunch of pussies these days, there is 1 quick way to check if the caravan belongs to the couple, and thats to check the serial number on the frame.
    if it matches the number they have on paper when they bought it, it should be returned to them.

    and even if the people who live in it bought it from some1, they should have known better then to buy something for 300 pounds when its obviously worth so much more, its there own stupid fault if they would lose that.

    Is not this a UK specific problem? In my county such act is illegal. They would be removed by the police.

    After reading the 3 articles. And maybe you should read it all too. The people currently living in that caravan brought it for 300 pounds. So therefore they are the orginal thieves. I agree that yes it would be wrong to throw them out on the street. But at the end of the day they have stolen goods and therefore the goods should go back to the rightful owner

    This is no human right issue, but a specific UK problem.

    Here in Germany a similar law exists, but it clearly states its boundaries: You can take on ownership of a stolen good, as long as you were in "gutem Glauben" (good faith) that the item belonged to the seller. You cannot be in good faith if you are negligent in determing the ownership of the item of the seller. Buying a caravan without any papers for a price less than 1% of the market value for sure is negligent, and the contract void.

    That means the original owners would get back their caravan, and the buyers of the stolen caravan can sue the thieves for the money they have paid.

    Also caravans are considered mobiles in german law (and not immobiles like a flat or a house), which means laws protecting people from eviction do not apply here.
