As for performance art, it's almost like she's subjecting the people in this tread to rape. Any publicity she gets is gravy, she already got a gig in the Hamptons where millionaires and billionaires will look at her art.

"This will be a fight against overwhelming odds from which survival cannot be expected. We will do what damage we can."
-- Capt. Copeland
Innocent until proven guilty -
There's not enough evidence to convict the man involved for rape
There's not enough evidence to prove she is lying about said rape
Therefore you have a situation where neither can be proven to be guilty, so both are assumed innocent in the eyes of the law.
In some states you are not legally capable of consenting to assault, and safe words are not recognized as withdrawal of consent. In most of those states, you're not legally entitled to negotiate any sort of roleplay that resembles nonconsent; if one partner asks or demands the other to stop and the other continues, the other is guilty of sexual assault according to the state. Strictly speaking, BDSM and "consensual nonconsent" are not legal in those states.
If, for instance, she'd made the video in Florida, and the footage includes her saying "no" or "stop" or him hitting her, the state can prosecute him for assault. If he can establish that she demanded that he do these things (if, for instance, the footage also includes her telling him to hit her again,) the state may even be able to prosecute her as an accomplice to her own assault.*

Ironically Emma Sulkowicz, the leader of "Carry That Weight", not only made the whole thing up, but also released the porno hours before the VICE documentary about her "college rape campaign" aired on HBO.
I miss when VICE was actually good. Now they're turning into another SJW clickbait company.
