Richard Foster, 49, of South Charleston, turned himself into police on a brandishing warrant.
A video originally posted to Facebook shows Captain Richard Foster, who appears to be off duty, holding a gun while he's exchanging words with two different men.
Nitro Police Chief Bobby Eggleton released a statement saying, "Capt Richard Foster has been placed on administrative leave until further notice. He has been relieved of his police weapons, vehicle and police identification. This is an ongoing internal investigation by the Nitro Police Department and a criminal investigation by the Kanawha County Sheriffs Office."
The Sheriff's Office says they are in the process of interviewing witnesses.
The person who took the video tells WSAZ the argument started because a group of people were trying to move a trailer onto a property that neighbors Capt. Foster's family.
According to the person taking the video, Foster's mother was blocking the way and asking to see the permits for the move.
When someone told her to get out of the way, she got her son involved.
WSAZ has reached out to the Foster family for comment but our messages haven't been returned.
