Even if it was true, it would still be allowed in the majority of the civilized world.
Over here consent is mainly needed for publishing, but even that is changing lately due to a case where someone posted a pic of a thief on social media.
We have more stricts rules for stuff like taking portraits, but it doesn't matter either, because all those laws pertain to taking photos that allow people to be identified.
Taking a photo of someone's hand or leg or butt does not fall into that category.
Criminalizing it to the point of prison time seems weird to me. What's the next step? Prison time for looking up while standing under escalators?

And I feel absolutely zero motivation for attempting to protect people doing these things, so let the prison sentence be a threat looming over them. Maximum sentence =/= what's actually handed out in any case.

Up-skirting is pretty much a victim-less act. The only thing that gets hurt is the woman's feelings. Would be great if we stopped caring so much about people's feelings.
Upskirting hardly affects the supposed victims. I mean really, somebody took a picture of your underwear (which you should be wearing unless you are a slut) without your permission? How traumatic. How truly traumatic.
Don't wear a skirt in public if you don't want your underside exposed? Can I sue for sexual harassment if a gust of wind blows their skirt up? If not then upskirting shouldn't really be a crime. They're taking a picture of something that is exposed to the public. Inb4 "you need to go to lengths to do so" when you could simply be below someone and bam right there. So is it only if you put your phone under them or is it if you simply take ANY photo of a woman's undercarriage? In the US if someone streaks, you're allowed to take as MANY photos as you want because they exposed themselves in public.

I want to start a trend of taking a picture of women's boobs in public. Not exposed ones, but just what's visible just looking, but obviously focussed on their boobs. Perfectly legal, but I bet this will be the next upskirting. I'm 100% gay as the day is long so it's merely to make a point.
