Honestly, nobody is going to give you a free pass on this. James is the one who got most of the KS money in the form of all that software Jason bought for him, including the new computer. James is the one who got the $4000 paypaled to his mother´s account. As soon as you switch games, people are going to know that the KS money from GM went for things being used to build the new game.
And just to be fair, this is not at all a bad plan
1. Dump the tainted company name
2. Make a new company, build up goodwill and branding for the new company
3. Dump the tainted game name
4. Built up a new game using the goodwill you built up using the new company
Nothing at all wrong with any of that. The only flaw in your plan is that in step #4, you still have incompetent and inexperienced people trying to build a MMORPG being lead by a nobody who doesn´t know they are incompetent and inexperienced.
You can have all the software Jason bought, you can have all the goodwill of the community, but you are still just backtracking to where GM was back in 2012.
