    Man arrested for intent to sell Scentsy as fake crack... wait what?

    I agree that the man should have been arrested for driving on a revoked license, but the other charges are a huge stretch. How the hell do you get from "man has a digital scale and a small number of scentsy cubes" to "man has intent to sell fake narcotics"? Well I guess it's good the man didn't have a small container of oregano or a box of baking soda, he could have been accused of being a fake narcotics kingpin!

    He is encouraging the crime that goes with drugs, people are out burgling and mugging in order to feed their addiction, he is happy to take their money for his fake drugs so he should be punished as a real drug dealer.

    I think he should only be charged with fraud.

    It would be like someone having sex with a midget thinking that midget was a child and then charging that person with sexual assault of a minor.

    Selling something as child pornography, even if no children are involved, is still illegal. So seek a better analogy.

    In almost every jurisdiction in the United States, selling fake drugs carries the same penalty as selling the real thing.

    If you are passing off baking powder as cocaine, you will get arrested for selling cocaine. If you sell oregano as weed to some kid, you can get arrested for selling weed. Passing off fake substances as real drugs can still be dangerous, depending on what chemicals are in them. It should absolutely carry the same penalty.

    It isn't fraud. Go find the law on the books for this state and I guarantee that there is a statute outlining the penalties for selling fake narcotics, and I would bet that the law doesn't mention fraud, but that it's punishable in the same way as selling real drugs.

    Nowhere in the artical does it say that he ever sold or attempted to sell said Scentsy cubes. They simply found the cubes and a digital scale and decided that the only explanation is that this guy was trying to sell scented wax as crack... give me a break

    Let a judge decide, I am sure he only wanted to weigh the stuff to make sure the store did not cheat him out of a few grams.

    You can't be charged for fraud for pretending to commit a crime lol.
    You can be arrested for about anything these days(gotta love murica's finest) but with any halfbaked attorney, most of these charges will be dropped.

    Intent to sell is a stretch most days, but intent to sell something that isn't illegal is pretty much a waste of the courts time.

    He could have had those in there from a prank he pulled on some friends, etc. Absolutely no chance of being convicted on anything.

    What this really goes to show is, don't ever let police search your car people.

    This. Just because it's not narcotics, doesn't mean it's safe to inhale/inject/ingest.

    People actually saying he shouldn't be charged, try to imagine if you now set the precedence that selling fake drugs is legal.
    Imagine how many would die from being sold cleaning supplies or non-prescription drugs in excess, or any other toxic shit people would pass off as drugs.
    Imagine how much more violence you'd create, from cause a HUGE influx in the drug-dealing business.
    Worst part is, you wouldn't even be allowed to arrest them.

    It happened in Oklahoma. Distribution and intent to distribute covers imitation substances as well. In fact, that's the case for a number of states.
