That's like saying if the person in the photo was a "minor" instead of an adult that it would just be a "civil case" and not involve jail time. Just because it is an adult doesn't make it any less illegal. The gym contacted the police for a reason. Read a book.

A Lawsuit pertains to a civil breach of contract or a tort, a lawsuit doesn't involve criminal charges. Just because the police are investigating this incident doesn't mean she is being charged, and even if they were gathering evidence against her it would ultimately be up to the district attorney to prosecute her. All police do is enforce the law and provide evidence to a prosecutor.
