They would just outright ban it if they feel it's not morally correct or suitable for any audience. Just like they did with Postal 2, Marijuana, certain alcoholic drinks, homosexuality etc etc. Your argument in your first post is valid and that's how things should be done, but the history of governmental conduct suggest that it won't be handled that way unfortunately.

My personal take on photorealism: I see it whenever I look out of the window, and I don't care for it one bit.
Oh, and there is one thing: No matter how real it is, games are games and reality is reality. Forget that and you have lost already.
With that in mind, even the holodeck wouldn'nt "harm" me. (I'd use the pornodeck first to begin with guhehe)
It was banned in Sweden as far as I know. They seem to have removed it from the ban list now though.

Our brains process things as if they were equally real on both sides of the aforementioned "uncanny valley". Only by being actively aware that what we're viewing or doing is fantasy are we able to tell the difference.
Military drone pilots kill people remotely with a joystick and a TV screen. Their understanding that they're killing real people is based on context, in exactly the same way as your understanding that you're killing fake people in Call of Duty.

If you can't differentiate between a video game and reality, the video game isn't the problem.
It someone is susceptible to that behaviour then realism will not matter.
There has already been such behaviour attributed to games, some of them not particularly realistic or accurate.
